The applicant (“Applicant”) named below agrees to fully comply with all terms and conditions herein. PURCHASES– All purchases by Applicant (or its agent, employee, or representative) of goods and/or services from Baileys Produce and Nursery will be made in person at the point of sale at Bailey’s in accordance with the terms and conditions of this Application. Sales Terms: Cash on Delivery (COD). Applicant agrees to pay the full amount, including any applicable taxes, with cash or card at the time the goods are sold on premises at Bailey’s store location in Pensacola Fl. Checks are not accepted. Representation and Warranty: Applicant expressly represents and warrants that they are in full compliance with any applicable state or federal laws & regulations for their intended use of the Product. Warranty: Product is sold "As is" Without warranty of any kind, either express or implied, Applicant accepts the sole risk for use and bears sole responsibility and all liability for any loss incurred due to failure of the product to meet their requirements Returns: No returns or refunds of any kind. Produce is sold in person and Bailey’s will help facilitate adequate inspection by Applicant to ensure that the Product is suitable for the intended use. Applicant agrees to only purchase Product that meets their requirements. RETURNED PAYMENTS– Applicant agrees to pay a fee of $50 or 10% of the payment amount (whichever is greater) for each occurrence of a returned payment. PRODUCT LIABILITY– Applicant expressly agrees that Baileys Produce shall not be responsible for any product nonconformity as to quantity, quality, or price. Applicant further agrees that to the maximum extent allowed by law, Bailey’s is not liable to the buyer or any third party for indirect, incidental, consequential, special, punitive, or exemplary damages related to the sale, possession, or use of the products, regardless of the legal theory and even if the seller was aware of the potential for such damages. APPLICATION RETENTION & REPRODUCTION– Applicant understands that Baileys Produce will retain this Application whether or not it is approved and any reproduction of this Application by reliable means will be considered an original. ACKNOWLEDGMENT & AGREEMENT– Applicant hereby certifies that the information furnished under this Application is true and correct. Application’s terms and conditions. Ordering and pickup times will be from 8am- 4pm Mondays through Saturdays, 10am-3pm on Sundays If a large quantity is required, an order must be placed before 9am Tuesday.
